Facilities regulated under Section 312(a) of the Emergency Planning and Community Right-to-Know Act (EPCRA) are required to submit an emergency and hazardous chemical inventory form by March 1 of each calendar year to the State Emergency Response Commission (SERC), the Local Emergency Planning Committee (LEPC), and the local fire department.
A facility is regulated if you stored a hazardous substance or extremely hazardous substance (EHS) greater than its reporting threshold during the previous calendar year (i.e. CY2022). These reporting thresholds are as follows:
Hazardous chemicals for which facilities are required to have or prepare an MSDS (SDS), the minimum reporting threshold is 10,000 pounds (or 4,540 kg.)
For Extremely Hazardous Substances (EHSs), the reporting threshold is 500 pounds (or 227 kg.) or the threshold planning quantity (TPQ), whichever is lower.
